September 17, 2014 — At least 40 people, including 38 in Hawaii, have filed lawsuits after suffering liver damage from taking OxyElite Pro supplements, according to Hawaii News Now.
There are currently 17 lawsuits involving 46 plaintiffs filed against USPLabs, LLC, the manufacturer of OxyElite Pro, and GNC, a vitamin supplement retailer. One attorney from Honolulu, Hawaii, has filed lawsuits on behalf of 38 plaintiffs. The litigation has grown rapidly, with 12 new lawsuits involving 40 plaintiffs filed in the last couple months.
Due to the sudden increase in the number of lawsuits, USPLabs has asked judges to reconsider establishing a centralized litigation in federal court.
It is possible that the number of lawsuits could continue to increase, because at least 72 people developed liver damage after taking OxyElite Pro between April and October 2013, according to the Centers for Disease Control (CDC).
Health officials in Hawaii were the first to notice an outbreak of liver injuries in patients who were using OxyElite Pro. At least three people needed liver transplants, including a 22 year-old man. One woman from Maui who had seven children died of liver failure. Hawaiian authorities pulled OxyElite Pro from store shelves and banned imports months before USPLabs recalled the supplements.
The U.S. Food and Drug Administration (FDA) traced the outbreak to aegeline, an unapproved ingredient in OxyElite Pro. The ingredient was added to OxyElite Pro in 2013, shortly after the product was re-formulated without DMAA, another dangerous ingredient that was linked to cardiac arrests.
