April 28, 2015 — Boston Scientific has agreed to settle nearly 3,000 vaginal mesh lawsuits for $119 million, or an average of $40,000 per claim, according to the Wall Street Journal.
The settlements resolved just a fraction of the 25,000 lawsuits that have been filed against Boston Scientific, including over 16,000 federal cases still pending in a federal court in West Virginia.
U.S. District Judge Joseph Goodwin, who oversees about 75,000 vaginal mesh lawsuits against seven major manufacturers in West Virginia, has advised device-makers to try to achieve settlements or face “potentially billions of dollars in verdicts.”
Boston Scientific was walloped by several jury verdicts last year. In November, four women who were injured by the Pinnacle mesh were awarded $26.7 million by a jury in Miami.
In September, a jury in Texas ordered Boston Scientific to pay $73 million to a woman who was injured by the Obtryx mesh. However, the award was halved to $34 million under state law capping punitive damages.
Boston Scientific and other mesh-manufacturers are accused of failing to adequately warn about the risk of complications, including erosion, infection, chronic pain, and the need for multiple corrective surgeries. In 2011, after receiving thousands of adverse event reports, the FDA warned that serious complications were “not rare.”
