Chobani Yogurt Class Action Lawsuit Filed

September 12, 2013 — A class action lawsuit has been filed against Chobani, one of the largest manufacturers of Greek yogurt in the United States. Plaintiff Harold J. Green filed the Chobani class action lawsuit in federal court in California on Monday, seeking damages for economic losses and breach of implied warranty on behalf of himself, his family, and other people who ate the yogurt.

The class action is not specifically seeking damages for food poisoning claims or other personal injuries. However, claims may be modified if future investigations link illnesses to the recalled yogurt. The U.S. Food and Drug Administration (FDA) has received at least 89 reports food poisoning, including symptoms like nausea and abdominal cramps.

Plaintiffs in the class action allege:

“Due to the negligent manufacturing of its Greek yogurt, manufactured and distributed to the public products which left Defendant’s manufacturing facilities containing a defect that poses a health threat to the public .”

Food Poisoning from Moldy Chobani Greek Yogurt

Chobani had not yet named the type of mold implicated in the recall when the class action lawsuit was filed. Green cited the U.S. Department of Agriculture, warning that some molds can produce poisonous toxins, cause allergic reactions, or respiratory problems.

Plaintiffs in the class action stated:

“Potentially hundreds, or even thousands, of Chobani customers are now left in the dark with information that is extremely relevant to the health and safety of not only themselves, but friends, family members, and even children.”

Recently, the Chobani yogurt recall was linked to Mucor circinelloides, a type of mold that is known to grow on industrial stirred-tank fermenters commonly used in the dairy industry. It is unlikely to cause foodborne illness, although opportunistic infections can occur in immunocompromised people who breathe the mold.
