March 6, 2014 — Denmark-based Coloplast Corp. has agreed to resolve about 400 vaginal mesh lawsuits, paying $16 million or an average of $40,000 per plaintiff, according to Bloomberg News.
The settlement wraps up lawsuits that were centralized in a Multi-District Litigation (MDL No. 2387) against Coloplast. Carl Tobias, a who teaches product liability law at the University of Richmond in Virginia, told Bloomberg:
“It appears that momentum is building for some type of global resolution as more of these vaginal-mesh cases settle.”
Many hope the resolution will set off a wave of settlements. Thousands of vaginal mesh lawsuits are currently pending in Multi-District Litigation (MDL) in West Virginia. Lawyers are engaged in settlement talks with C.R. Bard, American Medical Systems, Boston Scientific, Johnson & Johnson, and Cook Medical.
Most plaintiffs allege that vaginal mesh is defective and was not thoroughly tested. The most common complaint involves erosion of the mesh through the vaginal wall, a painful and debilitating complication that requires surgery. Even with surgery, vaginal mesh is often impossible to remove, leaving victims to suffer a lifetime of pain, infection, disfigurement, incontinence, organ prolapse, and psychological trauma.
