NOS Energy Lawsuit

NOS Energy Lawsuit

NOS Energy Drink was one of the most highly-caffeinated energy drinks on the market until it was reformulated in 2013. Unfortunately, it sent at least one teenager to the hospital with a seizure. Overdoses of caffeine are also associated with deadly cardiovascular events.

What is Nos Energy?

NOS is one of the most popular energy drinks on the market and is sold by Coca-Cola. It comes in a variety of flavors, but the main ingredients are caffeine, sugar, carbonated water, 1000-mg of taurine, guarana, L-Theanine, Vitamin B6, and other supplements.

What is the Problem?

The original formula for NOS contained 260-mg of caffeine per 16-oz can — significantly higher than all other major energy drinks. In 2013, Nos was reformulated with only 160-mg of caffeine.

Although the risk of caffeine toxicity is lower, drinking several cans could still lead to an overdose. Children, young adults, pregnant women, and people with pre-existing heart problems have the highest risk of health problems.

Missouri Teen Hospitalized After Drinking Nos Energy

A teenager in Missouri was hospitalized for five days after suffering a seizure shortly after drinking two large cans of Nos Energy Drink, the Associated Press reported in February 2011. The victim, Dakota Sailor, said it was the first time he had tried Nos. He now swears off energy drinks and warns other teens to do the same.

Study Links Energy Drinks and Health Risks for Kids

A study published in the journal Pediatrics warns that energy drinks pose serious risks for children and young adults. About 30-50% of teens have reported consuming energy drinks.

Researchers say the drinks often contain unregulated amounts of caffeine and have been linked to reports of diabetes, seizures, cardiovascular events, psychiatric disorders, and more.

According to authors of the study:

“Energy drinks have no therapeutic benefit. … caffeine and other stimulant substances contained in energy drinks have no place in the diets of children and adolescents.”

Soon after the study was published, the FDA began investigating adverse event reports involving energy drinks. By 2014, dozens of deaths and over 150 serious injuries had been linked to the most popular energy drinks. The New York Times also reported five deaths were associated with Monster Energy, including a 14 year-old girl who died of caffeine toxicity exacerbated by a heart condition after drinking two 24-oz cans.

Side Effects of Nos Energy Drink

Overdoses of caffeine can produce symptoms ranging from mild “caffeine jitters” to catastrophic cardiac arrest. Some of the most serious risks of caffeine toxicity from Nos Energy include:

  • Heart palpitations
  • Chest pain
  • Irregular heart rhythm
  • High blood pressure
  • Increased heart rate
  • Heart attack
