What is the problem?

Victoza (liraglutide) is a prescription injection medication for type-2 diabetes that was developed by Novo Nordisk. It belongs to a new class of diabetes drugs called incretin mimetics, which work by mimicking hormones in the pancreas that regulate blood-sugar levels.

The problem is that several recent studies have raised concern that drugs in the incretin mimetic class may increase a patient’s risk of pancreatitis. Over time, chronic pancreatitis is known to increase the risk of pancreatic cancer, and some studies support this risk.

Major Study Links Victoza and Pancreatic Cancer

In June 2016, the LEADER clinical trial found that 15 cases of pancreatic cancer in patients on Victoza, compared to only 5 patients on a placebo, out of roughly 4,670 patients in each group. The risk was low, but the study only tracked patients for 3.5 to 5 years. Pancreatic cancer often takes much longer to develop. Click here to read more.

Victoza Class Action Lawsuit

Over 800 lawsuits involving pancreatitis and pancreatic cancer have been filed by people who took Victoza, Byetta, or Januvia. These lawsuits are not part of a class action. Instead, they are individual lawsuits that have been centralized in one federal court.

Victoza MDL

The lawsuits are centralized in a Multi-District Litigation (MDL No. 2452), In RE: Incretin-Based Therapy Product Liability Litigation in California. The Victoza MDL is similar to a class action because it aggregates a large number of claims in one court. Unlike a class action, each lawsuit is independent and can have its own outcome.

About Class Actions

Class actions are lawsuits involving a large group of people who have essentially the same legal claim against the same defendant. The law firm representing the group chooses a “class representative” and uses that person’s case to argue for compensation on behalf of the whole group. Members typically share any compensation awarded through a jury verdict, settlement, etc.

Why Our Law Firm is Filing Individual Lawsuits as Opposed to a Class Action

The Schmidt Firm, PLLC is nationally recognized as a class action law firm, but we are not filing a Victoza class action. We are concerned that a class action is not ideal for our clients with severe injuries. Members of a class action are often forced into higher attorneys’ fees and a “low-ball settlement.”

Our trial attorneys specialize in helping victims of defective drugs seek maximum financial compensation and justice. We always review new cases for free, and we typically work on contingency-fee. If you decide to file a lawsuit, you could receive compensation for pain and suffering, medical expenses, lost income, death of a family member, and other damages.
