July 29, 2015 — A jury in Los Angeles has awarded $9.2 million to a man who was severely injured by the Durom Cup, a hip implant made by Zimmer Inc.
It is believed to be the first time Zimmer has lost a trial involving metal-on-metal hip implants. In the last nine months, the company won trials in Indiana and New Jersey.
After a three-week trial in Los Angeles Superior Court, the jury found that the Durom Cup was defectively designed and Zimmer was liable for failing to adequately warn about potential risks.
According to Reuters, 59 year-old Gary Kline was awarded $8 million in past and future non-economic damages, plus $153,000 for his medical expenses.
Attorneys for Kline told the jury he is “still dealing with the lingering effects of having two traumatic surgeries in the span of 15 months and scar tissue and muscle damage that goes along with that.”
Zimmer pulled the Durom Cup off the market in 2008 over concerns that it could loosen prematurely and cause painful complications that require revision surgery. The FDA also warns that metal-on-metal hip implants can cause metal poisoning and systemic reactions in other parts of the body.
Unfortunately, by that time about 13,000 people were implanted with the component. Nearly 400 lawsuits have been filed against Zimmer since a federal litigation was created in New Jersey in 2010.
