What Are AirPods?

AirPods are wireless headphones that are manufactured by Apple to be used with iPhones. The original AirPods were released in December 2016. Apple has sold several versions, including AirPods with a wireless “earbud” design and AirPods Max with a traditional over-the-ear design.

What is the Problem?

Lawsuits claim that AirPods are defective because they can produce extremely loud Amber Alerts an other notifications, even when the volume is set low. Apple is accused of failing to fix the problem with a simple update that would automatically limit the volume to a safe level.

AirPods Hearing Loss Lawsuit

In May 2022, a lawsuit was filed against Apple by the parents of a teenage boy who suffered permanent hearing loss caused by AirPods.

The parents claim that their 12-year-old son, identified as “B.G.” in court documents, lost his hearing in his right ear when an Amber Alert came through on an AirPods at an “ear-shattering” volume.

The noise allegedly “tore apart B.G.’s ear drum, damaged his cochlea, and caused significant injuries to B.G.’s hearing.” He now must use a hearing aid in his right ear for the rest of his life. The damage also causes bouts of dizziness, vertigo, nausea, and pain.

The Apple AirPods Lawsuit is Gordoa v. Apple Inc. et al in the U.S. District Court for the Northern District of California — Case Number 3:22-cv-02900.

Apple AirPod Max Class Action Lawsuit

A class action lawsuit was filed against Apple on behalf of consumers who bought AirPods Max headphones.

The lawsuit alleges that a defect causes condensation (water) to accumulate inside the ear cups on AirPods Max wireless earbuds, sometime after just a few hours.

The problem damages the overall experience of using the AirPods Max in several ways, such as:

  • Loss of sound, or poor quality sound in one or both ear cups
  • Ear detection problems
  • Failure to activate noise-cancellation features
  • Problems with battery charging
