Body Snatcher Lawsuit Filed Against Biological Resource Center

In December 2015, ABC News reports that the families of eight deceased people filed a lawsuit accusing Phoenix-based Biological Resource Center of illegally harvesting their body parts for profit. The business was raided by federal officials in 2014.

The punishment for these crimes? Probation and deferred jail for the 48 year-old owner, Stephen Gore, who pled guilty to a felony. The lawsuit claims Biological Resource Center:

  • Sold bodies and body parts for profit
  • Shipped bodies internationally to unknown entities
  • Failed to use body parts for scientific study, medical uses, or education
  • Kept bodies for years without using them
  • Did not handle bodies with dignity or respect
  • Harvested body parts against the will of the deceased person

The Truth About Organ Donation

This is the macabre truth about being an organ donor: Doctors do not wait until you are dead. Organs are usually harvested when the patient is on the verge of death, often when the heart is still beating and the brain has electrical activity. The patient is rarely anesthetized during the process.

Lawsuit: “Cutters” Speed Death to Harvest Organs

A lawsuit filed against the New York Organ Donor Network in 2012 alleges that “cutters” in hospitals pressured doctors to declare patients brain dead — even when the patients were still breathing — so they could harvest organs.

Biomedical Tissue Services Lawsuit

Michael Mastromarino and his body-snatching company Biological Tissue Services were sued in 2006 for stealing body parts from 1,077 cadavers at 30 funeral homes without permission, selling unscreened tissue for profit, and forging documents to cover his tracks.

What is the problem?

Organ harvesting and transplants are a $20 billion a year industry. None of the profits go to organ donors or their families. In fact, selling body parts for a profit is illegal — but “processing fees” are legal.

How much is a dead body worth? A federal investigation into one illegal operation in New York found human heads selling for $500, arms for $750, and a whole body for $5,000. In other cases, whole bodies sell for tens of thousands of dollars.

This creates a lucrative market for “body snatchers.” While some companies target funeral homes, others have employees inside hospitals pressuring doctors to declare patients brain dead so they can harvest the organs.

Stolen Organs Can Carry Diseases

Stolen body parts can pass along diseases, such as cancer, HIV, hepatitis, syphilis, and sepsis. For example, the host of “Masterpiece Theater” on PBS, Alistair Cooke, died of lung cancer that metastasized to his bones and still had his bones stolen for implants before he was cremated, according to a lawsuit filed by his family.
