May 6, 2015 — Attorneys for a woman who was severely injured by Boston Scientific’s Pinnacle pelvic mesh implant have presented opening arguments to a jury in California.
Law360 reports that the federal lawsuit was filed in 2012 by Roseanne Sanchez. After she was implanted with the mesh, she developed incontinence and chronic pain.
Attorneys for Ms. Sanchez accused Boston Scientific of negligence for marketing the Pinnacle implant as safe. Boston Scientific allegedly changed the mesh material and the shape of the implant, but failing to adequately test the product.
The changes included a new type of plastic (polypropylene) that had warnings against use as a permanent implant. The material also was not supposed to be used in parts of the body that would be exposed to fluids.
Boston Scientific is facing thousands of similar legal claims involving the Pinnacle implant. Several cases have already gone to trial with mixed results. Last year, Boston Scientific won a trial in Massachusetts, according to Bloomberg.
Just months after that verdict, Boston Scientific lost a trial when a jury in Florida ordered the company to pay $27 million to four women who were injured by the Pinnacle implant.
Boston Scientific is currently facing more than 24,000 lawsuits from women who were injured by a variety of the company’s mesh products. Last month, nearly 3,000 lawsuits settled for $119 million, or about $40,000 per claim.
