January 19, 2016 — The first lawsuits have been filed against Janssen Pharmaceuticals by people who took Invokana and were diagnosed with diabetic ketoacidosis.
One lawsuit (PDF) was filed on December 15 in the U.S. District Court for the Southern District of Alabama (Case No. 1:15-cv-00636) by Luana Jean Collie. According to the complaint, she started taking Invokana in December 2014 and developed ketoacidosis soon afterward.
She says she never would have taken Invokana if she had known about the risks. The lawsuit accuses Janssen of negligence for failing to warn about side effects, failing to adequately study the risks of Invokana, and marketing Invokana “off-label” for weight loss, lowering blood-pressure, and people with type-1 diabetes.
A similar lawsuit was filed in the Philadelphia Court of Common Pleas (Case No. 15-12-00653) on December 10 by plaintiff Arthur Portnoff. He says he started taking Invokana in November 2014 and was diagnosed with ketoacidosis three months later.
Both of the lawsuits were filed just days after the FDA issued a Safety Communication about ketoacidosis and ordered Janssen to update the label on Invokana.
Ketoacidosis is a life-threatening condition that occurs when the blood becomes too acidic. It can develop in as little as 24 hours and cause coma or death without treatment. The FDA recommends seeking emergency medical treatment for symptoms like nausea, vomiting, abdominal pain, tiredness, and trouble breathing.
