September 2, 2016 — Lawyers representing over 1,700 people who took Benicar are asking a judge to agree that it causes sprue-like enteropathy so they can pursue claims that Daiichi Sankyo failed to warn about the risk.
In a report (PDF) filed on August 29, lawyers announced their intention to seek partial summary judgement on the issue of general causation based on numerous admissions in depositions.
They will also seek partial judgement on the issue of whether Daiichi Sankyo provided adequate warnings about sprue-like enteropathy. The website www.Benicar.com warns:
“Serious side effects may include severe, chronic diarrhea with considerable weigh loss, which may develop months to years after starting Benicar.”
In 2012, Mayo Clinic researchers published 22 case reports of sprue-like enteropathy in Benicar patients. In 2013, the FDA issued a Safety Communication and said there was “clear evidence” linking Benicar and sprue-like enteropathy.
Benicar has been used by 2 million people since it was approved in 2002. Because it lacked warnings about sprue-like enteropathy for over a decade, many victims were misdiagnosed for years.
The symptoms include chronic diarrhea, nausea, malnutrition, dehydration, weight-loss, and intestinal damage (villous atrophy).
As of August 22, there were 1,718 lawsuits pending in a federal Multi-District Litigation (MDL No. 2606). Another 73 cases are centralized at the state level in New Jersey. The first trial-dates have been scheduled for 2017.
