The Safeway Distribution Center in Tracy, California, is a massive warehouse that employs around 1,700 people. It was hit by an outbreak of COVID-19 in mid-March that infected at least 51 workers.

Safeway Hit With COVID-19 Death Lawsuit in California

In May 2020, the widow of a man who died of COVID-19 complications filed a wrongful death lawsuit against Safeway.

What Happened?

The lawsuit was filed on behalf of Pedro Zuniga, a healthy 52 year-old father of 5 children who died of COVID-19. He was a longtime employee of the Safeway Distribution Center in Tracy, California, where he worked in the produce department for 22 years.

According to his son, Zuniga began showing symptoms of COVID-19 on April 1. Soon afterward, he was hospitalized in the ICU and developed pneumonia. Tragically, he died on April 13 of cardiac arrest and respiratory failure caused by COVID-19.

Safeway Finally Starts Screening Employees

After Zuniga died, Safeway finally began screening all employees for fever and other symptoms before entering the Tracy facility. The lawsuit calls these actions “woefully delayed” and “too little, too late.”

COVID-19 Lawsuit Accuses Safeway of “Hazardous Conditions”

The lawsuit alleges that Zuniga was forced to work in “dangerous and hazardous conditions” at the Safeway warehouse.

Despite co-workers who were showing symptoms of COVID-19, the lawsuit claims that employees of the distribution center were forced to work in close contact with each other, without any personal protective equipment.
