January 19, 2015 — Two men from California who developed sprue-like enteropathy after taking Benicar have filed a lawsuit.
The lawsuit was filed last week in the U.S. District Court for the Northern District of California against Daiichi Sankyo and Forest Laboratories, the drug-makers who co-marketed Benicar from 2002-2008.
The men, Louis Verduzco of Oakland, and Michael Ewald of Bakersfield, both used Benicar for the treatment of high blood pressure. Soon afterward, they developed severe intestinal diseases, including sprue-like enteropathy, intestinal damage (villous atrophy), several forms of colitis, and malabsorption of nutrients.
These complications caused chronic diarrhea, rapid weight-loss, vomiting, nausea, malnutrition, dehydration, and/or sudden kidney failure.
Both men had to undergo medical treatment and they continue to require monitoring for complications.
Daiichi and Forest are accused of failing to adequately warn about the side effects of Benicar. The FDA has issued several warnings. The first, back in 2006, was issued because marketing materials made “false or misleading” claims that Benicar was better than other blood-pressure drugs.
The FDA also issued a Safety Communication for Benicar in July 2013, after researchers in Minnesota linked the drug to dozens of cases of intestinal damage. The agency ordered drug-makers to update labels to warn that sprue-like enteropathy could be caused by Benicar, Benicar HCT, Azor, Tribenzor, and generic olmesartan.
