Flavoring chemicals like diacetyl increase the risk of lung diseases like “Popcorn Lung,” but they are also commonly found in vaping liquids. Now, a growing number of manufacturers are facing class actions for selling dangerous products and failing to warn consumers about the risk.

Chemicals Linked to Lung Disease Found in Vaping Liquids
A new study from the Harvard School of Public Health has linked vaping liquids to a serious lung disease, bronchiolitis obliterans. The disease, nicknamed Popcorn Lung, has been found in workers who were exposed to high levels of the flavoring chemical diacetyl.
The Harvard researchers found diacetyl in 76% of 51 vaping liquids and e-cigarettes that were tested. In most cases, the amount of diacetyl was lower than what is found in the average tobacco cigarette. However, some vaping liquids contain significantly more diacetyl than the government’s daily occupational exposure limit.
Five Pawns Vaping Class Action Lawsuit
In November 2015, Five Lawns Inc. was hit with a class action (PDF) after lab results showed exceptionally high levels of diacetyl and acetyl propionyl in several flavored vaping liquids.
The company is also accused of lying about the chemicals in their products, insisting they were free of diacetyl. In reality, one flavor called Absolute Pin had 40 μg/ml of diacetyl and an astonishing 2,500 μg/ml of acetyl propionyl. According to the complaint:
“This means, if a person inhales just 2ml of Absolute Pin e-liquid they will be over the recommended intake for DA and more than 36 times over the recommended daily limit for AP.”
What is the problem?
The Schmidt Firm, PLLC is nationally recognized as a class action law firm, but our attorneys are not filing a vaping class action at this time. Instead, we are filing individual lawsuits on behalf of people with severe injuries.
About Class Actions
Class action lawsuits have already been filed against Cuttwood LLC, Five Pawns, Inc, and other vaping liquid manufacturers. However, these lawsuits are not intended to maximize compensation for people with lung damage — they are seeing refunds for people who bought products containing flavoring ingredients.
Why Our Law Firm is Filing Individual Lawsuits as Opposed to a Class Action
Members of class action lawsuits may have to accept a “low-ball” settlement or higher attorneys fees. Any compensation awarded through a settlement or courtroom verdict is typically divided among everyone in the lawsuit.
Instead of a class action, our attorneys are focusing our efforts on individual cases involving bronchiolitis obliterans and other side effects. If you were injured, you may be eligible to join this litigation and seek compensation for your pain and suffering, lost income, medical expenses, and more.
