Blue Bell Recalls Cookie Dough Ice Cream

On September 20, 2016, Blue Bell recalled two flavors of cookie dough ice cream due to a risk of Listeria. On October 10, Blue Bell expanded the recall to include three more flavors that were made with tainted cookie dough between February 2, 2016 and September 7, 2016

. No illnesses have been reported. The problem was blamed on a third-party cookie dough supplier. However, the supplier said its cookie dough was negative for Listeria before it was shipped, and only tested positive after it had been at Blue Bell for nearly two months.

The recalled ice cream products include:

  • Chocolate Chip Cookie Dough — 1/2-gallons and pints
  • Cookie Two Step — 1/2-gallons and pints
  • Blue Monster — 3-gallon
  • Chocolate Chip Cookie — 3-gallon
  • Krazy Kookie Dough — 3-gallon

Blue Bell Recalls All Ice Cream Products

April 2015 — Blue Bell Creameries, Inc., of Brenham, Texas, has issued a voluntary recall for all ice cream, frozen yogurt, sherbet, and frozen snacks products produced at all facilities because they may be contaminated with Listeria monocytogenes.

Listeria Food Poisoning

Listeriosis is a life-threatening infection that has an incubation period of 3-70 days and the illness lasts for days or weeks. Infection is most serious for young children, older adults, and people with weak immune systems. Pregnant women may have only mild symptoms, but can suffer a miscarriage. Symptoms may include:

  • Fever
  • Stiff neck
  • Confusion
  • Weakness
  • Vomiting
  • Diarrhea

What’s the problem?

The Schmidt Firm, PLLC is nationally recognized as a class action law firm, but our lawyers are not filing a Blue Bell ice cream class action. Instead, we are filing individual lawsuits and only accepting cases involving people who were diagnosed with Listeria after consuming recalled products.

About Class Actions

Blue Bell Creameries may face class action lawsuits on behalf of consumers, retailers, and food service customers who are seeking reimbursement and other financial damages related to the recall, according to Law360. However, this type of class action may not be ideal for people with very severe injuries.

Why Our Law Firm is Filing Individual Lawsuits Instead of a Blue Bell Class Action

Listeria infections linked to Blue Bell ice cream have been extremely serious, with at least 10 people hospitalized and three deaths reported. Although many people have been injured, a class action might not be the best way to seek justice. Members may have to accept a “low-ball” settlement with higher attorneys’ fees.

Instead of a class action, our law firm files individual lawsuits. We provide personal legal representation to victims of food poisoning outbreaks. We specialize in holding manufacturers accountable for selling contaminated food and failing to ensure the safety of their products.

If you decide to file a lawsuit, you could receive substantial compensation for your illness, pain and suffering, medical expenses, lost income due to hospitalization, and/or wrongful death of a family member.
