DePuy Hip Implant Class Action Lawsuit

DePuy Orthopedics is facing over 10,000 lawsuits involving the ASR and Pinnacle hip implants, but they are not part of a DePuy hip implant class action. The problem is that metal-on-metal hip replacements can potentially release toxic particles of metal into a patient’s hip joint, which can contribute to premature failure and revision surgery.

What You Can Do & How a DePuy Hip Implant Lawsuit Can Help

The Schmidt Firm, PLLC is currently accepting DePuy hip implant induced injury cases in all 50 states. DePuy Hip Implant Class Action Lawsuit

DePuy has agreed to pay at least $2.5 billion to resolve about 8,600 lawsuits involving the DePuy ASR, a metal-on-metal hip implant that was pulled off the market in 2010 over safety concerns. Recent studies have linked the ASR to a 40% five-year failure-rate. DePuy is also facing over 5,000 additional lawsuits involving the Pinnacle, another all-metal hip implant that has not been recalled.

The litigation is not centralized in a DePuy hip implant class action. Instead, lawyers have filed individual lawsuits and most of the cases have been transferred to one federal court, under one judge. The Pinnacle Multi-District Litigation (MDL No. 2244) is proceeding in Texas, and the ASR litigation (MDL No. 2197) is proceeding in Ohio.

What is the problem?

The Schmidt Firm, PLLC is nationally recognized as a class action law firm, but our defective medical device attorneys are not filing a DePuy class action. Instead, we are filing individual lawsuits on behalf of people who developed complications of a defective hip replacement.

  • Metallosis (metal poisoning)
  • Chronic pain
  • Inflammation and swelling
  • Bone loss
  • Systemic reactions in other areas of the body
  • Decreased mobility or flexibility
  • Additional surgery
  • And more

About Class Actions

For people with severe injuries, class actions have disadvantages. Members of class action are often forced into higher attorneys’ fees or a “low-ball” settlement. The success or failure of a class action depends on a “class representative,” and if compensation is awarded, it is typically divided among everyone in the class action.

Why Our Law Firm is Filing Individual Lawsuits as Opposed to a DePuy Hip Implant Class Action

The Schmidt Firm, PLLC specializes in helping victims of defective medical devices seek compensation and justice for their injuries. We understand that a defective hip replacement can cause debilitating pain, ongoing medical expenses, lost income due to time off work, and lifelong complications.

Our trial attorneys file individual lawsuits because we believe this is the best way to help each of our clients maximize their financial recovery. Our attorneys always review new cases for free. In most circumstances, we also work on contingency-fee. Contact us today for more information.
