Morcellator Class Action Lawsuit

In the last few years, a growing number of studies and case reports have linked morcellators with aggressive uterine cancer. When morcellators grind up tissue, they often leave tiny pieces behind. For women with undiagnosed uterine cancer, this procedure can “seed” highly-aggressive cancer throughout the pelvis and abdomen.

What You Can Do & How a Morcellator Lawsuit Can Help

The Schmidt Firm, PLLC is currently accepting morcellator induced injury cases in all 50 states. If you or somebody you know was injured by uterine cancer after a hysterectomy, you should contact our lawyers immediately for a free case consultation. UPDATE: FDA Adds “Black Box” Warning About Morcellator Cancer Risk

November 24, 2014 — Stopping short of an outright ban on morcellators in gynecological surgery, the FDA has instead added a “Boxed Warning” that limits the use of morcellators for the vast majority of women. Click here to read more.

Morcellator Class Action Lawsuit Information

In April 2014, the U.S. Food and Drug Administration (FDA) recommended against using morcellators in hysterectomies. Since then, several women who developed aggressive cancer have filed lawsuits against manufacturers for failing to warn doctors and patients about this side effect.

These morcellator lawsuits are not consolidated into a class action — instead, they are individual claims filed by women who have hired their own attorney. If the litigation continues to grow, it is possible that judges will centralize the litigation into a federal Multi-District Litigation (MDL).

What is the problem?

The Schmidt Firm, PLLC is nationally recognized as a class action law firm, but our Defective Medical Device Litigation Group is not filing a morcellator class action lawsuit. Instead, we are filing individual lawsuits on behalf of women who were diagnosed with uterine cancer or leiomyosarcoma (LMS) following treatment with a laparoscopic power morcellator.

About Class Actions

Class actions are beneficial when a large number of people purchase a defective product and want to be reimbursed. Class actions typically seek compensation on behalf of thousands of people. However, for individuals with severe injuries, class actions are not always ideal. Members are often forced into blanket “low-ball settlements” and higher attorneys’ fees.

Why Our Law Firm is Filing Individual Lawsuits as Opposed to a Morcellator Class Action

Our trial attorneys specialize in helping people file lawsuits against manufacturers of defective medical devices. We believe that individual lawsuits are the best way to help each client maximize their financial recovery.

Morcellators are associated with aggressive cancer, a disease that can cause devastating physical, emotional, and financial losses. If you decide to file a lawsuit, our attorneys can help you seek compensation for you or your loved one’s pain and suffering, medical expenses, lost income, wrongful death, and more. We always provide free case consultations. In most circumstances, we also work on contingency-fee. Contact us today to learn more.
