October 11, 2013 — KVUE Austin has reported that OxyElite Pro, a popular fat-burning supplement made by USPLabs in North Texas, has been linked to at least 29 cases of acute hepatitis (liver inflammation) and liver damage. Reported interviewed personal trainers and emergency physicians, who warned “Buyer beware.”
Many health experts are concerned that people who take OxyElite Pro (especially counterfeit products) under-estimate the risk to their health. USPLabs has already paid over $2 million in a class action lawsuit accusing them of violating false-advertising lawsuits. USPLabs admitted no wrongdoing, but agreed to place stronger warnings on the label.
The problem is that the label may still be misleading. KVUE Austin interviewed Dr. Toss Tobleman, director of emergency medicine at Scott & White Hospital in Round Rock, warned about the marketing of supplements:
“It is certainly ‘buyer beware’ … When that medication or that herbal supplement can be potentially dangerous, especially in higher amounts, that’s when people start getting into trouble. … They’re using terms like ‘natural’ and ‘pro,’ and it’s marketing. It’s out there for everybody instead of saying, ‘This is a serious substance.’”
In October 2013, health officials in Hawaii embargoed shipments of OxyElite Pro and ordered GNC to take the product off store shelves. Although GNC initially refused, they have agreed to stop selling the product. USPLabs has not issued a formal recall with the FDA, but they have agreed to stop distributing it nationwide.
