$41 Million Awarded to Woman Injured by Vaginal Mesh

February 1, 2019 — A jury has ordered Johnson & Johnson to pay $41 million to a woman from Pennsylvania who was injured by vaginal mesh.

The lawsuit was filed against Johnson & Johnson’s medical device subsidiary Ethicon by Suzanne Emmett and her husband.

Emmett was implanted with vaginal mesh in May 2007 and soon began experiencing complications when it began eroding through her soft tissues and into her vagina.

Over the next few years, the mesh eroded into her vagina 14 times and caused her to suffer significant discomfort, bleeding, infections, pain during sexual intercourse, and other debilitating side effects.

She underwent 9 surgeries in an attempt to correct the problems, including nearly a dozen chemical cauterizations, but continues to suffer from scarring and other permanent problems to this day.

Her lawyers accuse Johnson & Johnson of failing to adequately warn her about the high failure rate associated with vaginal mesh, and specifically the risk of erosions. The company is also accused of selling a defective medical device with unreasonable safety risks.

Johnson & Johnson is currently facing over 37,400 vaginal mesh injury lawsuits in a centralized federal litigation in West Virginia.

Another 90 lawsuits are still pending in state court in Pennsylvania, where juries have now ordered the company to pay over $145 million to women who were injured by vaginal mesh implants.

The lawsuit is In RE: Suzanne Emmet et al. v. Ethicon Inc. et al.Case No. 130701495 before the Court of Common Pleas of Philadelphia County, Pennsylvania.
