ABC Dophilus Powder Linked to Deadly Infection

Solgar Inc. sells the probiotic supplement ABC Dophilus specifically for the treatment of children and infants.

Some peer-reviewed studies have suggested that probiotics could help prevent necrotizing enterocolitis in premature infants, but this use has never been evaluated in clinical studies and is not FDA-approved. Furthermore, the FDA has warned that the studies lacked documentation about safety risks.

ABC Dophilus is advertised as a mix of “beneficial friendly bacteria,” but FDA tests on an unopened bottle detected Rhizopus oryzae. This mold is commonly found in soil and rotting plant material.

When ABC Dophilus was given to a premature infant as part of the normal in-hospital course of treatment, the infant developed a severe fungal infection known as mucormycosis.

The FDA recalled ABC Dophilus in December 2014 and warned:

“These products are not subject to FDA’s premarket review or approval requirements for safety and effectiveness, nor to the agency’s rigorous manufacturing and testing standards for drugs, including testing for extraneous organisms.”

What is the problem?

The Schmidt Firm, PLLC is nationally recognized as a class action law firm, but instead of an ABC Dophilus class action, we are filing individual lawsuits and only accepting cases involving severe injuries, such as mucormycosis and fungal infections.

About Class Actions

Class actions are a popular way for hundreds or even thousands of people to collectively seek justice for the same legal claim. In fact, you may have even been part of a class action. They are often used to provide reimbursement for people who purchased a product that was falsely advertised, for example.

Why Our Law Firm is Filing Individual Lawsuits as Opposed to a Class Action

For individuals with very serious injuries, class actions have a number of disadvantages. Members may have to accept a “low-ball” settlement with higher attorneys’ fees. Their case may never be selected to go to trial, and even if compensation is awarded, it must be divided among everyone in the lawsuit.

Our attorneys file individual lawsuits as opposed to class actions because we believe in providing personal legal representation to people with serious injuries. If you decide to file a lawsuit, we may be able to help you seek compensation and justice for your child’s injury, medical expenses, pain and suffering, future treatment, your lost income, and more.
