Actos Class Action Lawsuit Information

Takeda Pharmaceuticals Inc., the manufacturer of Actos, has been hit with about 2,700 lawsuits involving bladder cancer. These lawsuits are not part of an Actos class action — they are individual lawsuits. Most of the cases are centralized in federal court in Louisiana.

In April 2014, Bloomberg reported that the company was ordered to pay $6 billion in punitive damages to a man who was injured. Eli Lilly & Co., the co-marketer of Actos in the United States, was ordered to pay $3 billion.

The plaintiff, Terrance Allen, was also awarded $1.5 million in compensatory damages. Although the massive punitive award will likely be reversed, a major factor was Takeda’s destruction of vital documents on 46 employees who developed and marketed Actos. Click here to read more.

What is the problem?

The Schmidt Firm, PLLC is nationally recognized as a class action law firm, but our attorneys are not filing an Actos class action. There are thousands of lawsuits involving Actos and bladder cancer, but these are not consolidated into a class action. Instead, they are individual claims filed by people who hired an attorney.

About Class Actions

Class action lawsuits are useful when a lot of people need to file a similar legal claim against the same defendant. They are also a popular way for people to seek a refund for buying a defective drug. However, for individual plaintiffs with severe injuries, class actions can have disadvantages. Plaintiffs may have to accept higher attorneys’ fees or a “low-ball settlement.” Even if compensation is awarded, typically it must be shared among everyone in the lawsuit.

Why Our Law Firm is Filing Individual Lawsuits as Opposed to an Actos Class Action

The trial attorneys at The Schmidt Firm, PLLC help victims of pharmaceutical drugs seek compensation and justice from drug-makers who fail to warn about severe side effects. Bladder cancer is an extremely serious injury that can cause devastating physical pain and suffering, emotional anguish, medical expenses, disability, and death.

We believe individual lawsuits are the best way to help each of our clients maximize their financial recovery for these injuries. Our lawyers always review new cases for free, and in many circumstances, we provide representation on contingency-fee. If you need to file a lawsuit, contact us today.
