UPDATE: Dallas Woman Dies in Texas Six Flags Roller Coaster Accident

July 22, 2013 — The family of Rosy Esparza has hired an attorney and they may file an amusement park accident lawsuit. Esparza died after falling from the Texas Giant ride at Six Flags Over Texas in Arlington.

June 6, 2012 — An investigation led by the Orange County register has found that, since 2007, Disney theme parks have been the subject of 140 personal injury lawsuits. Most of the cases settled out of court or were dismissed. One law professor quoted in the article said that amusement parks have a public-relations incentive to settle cases quickly and quietly, to avoid negative publicity.

Some examples of amusement park injury lawsuits that settled out of court:

  • A man who was burned when a Disneyland employee poured hot coffee on his arm
  • A woman who slipped in eggs left on the ground at a Disneyland hotel
  • A man who was injured when he sat on a bench that rolled over
  • A man who was hit in the head by a sheet of metal that flew off a food cart

Amusement Park Injuries

Not all amusement park injuries are the fault of the park itself. Accidents happen, and sometimes people are careless. However, other times, the amusement park or its employees are at fault. Perhaps an employee did not clean up a spill, which then caused a patron to slip and all. Maybe an amusement park ride was not safely designed, and a child was seriously injured. Or perhaps poor sanitation led to an outbreak of food poisoning, sickening hundreds. There is a long list of possible things that could cause an injury at an amusement park.

Unfortunately, a serious amusement park injury can result in expensive medical bills, pain and suffering, lost income, and more. Even more troubling is the fact that many people have their vacation entirely ruined by the amusement park injury.

If you, your child, or your loved one was injured at an amusement park, you are not alone. You may be entitled to significant financial compensation by filing an amusement park lawsuit. Contact The Schmidt Firm, PLLC today for more information.

Slips, Trips, and Fall Injuries

Some of the most common injuries are slips, trips, and falls. These injuries are most common in theme parks featuring water elements. People can easily slip and fall in a pool of standing water. Slip and fall injuries can occur while boarding a ride, around water slides, sidewalks near fountains, and more.

Other times, falls and trips occur because of a poorly designed area in the park. Perhaps a walkway lacked railings, or an elevated curb was not easily visible, or a staircase was designed with a slippery surface. If you have slipped, fallen, or tripped at an amusement park, you could be entitled to financial compensation for your injury.

A serious slip, trip, or fall can cause the following injuries:

  • Broken bones
  • Cuts, scrapes, and lacerations
  • Sprains
  • Strains
  • Pulled muscles
  • Injuries to tendons, ligaments, or muscles
  • Head, neck, or back injury
  • And more

Ride & Roller Coaster Injuries

Were you injured while riding an amusement park ride? Many amusement park injuries occur on defective rides or roller coasters. These injuries may occur because the ride was not designed safely, or because an employee did not secure patrons properly, or because the ride itself is malfunctioning, or for another reason.

Although amusement park rides are usually designed with safety in mind, serious injuries do occur on roller coasters and rides. Roller coasters designed with aggressive drops, jolts, and jerks could cause whiplash or exacerbate back injuries. On water park slides, a collision could occur at the bottom of a slide if an employee allows more than one person on the slide at a time. Severe neck injuries, head injuries, lacerations, death, and other injures have all occurred on roller coasters and rides.
