Overview

The Bair Hugger is a special blanket used to keep surgery patients under anesthesia warm. It works like a forced-air heater, pushing warm air through a hose into a blanket that is draped over an unconscious patient.

The problem, critics say, is that the Bair Hugger can spread bacteria associated with hospital-acquired infections, according to the New York Times.

Lawsuits have already been filed by a man who had to have his leg amputated after developing an antibiotic-resistant infection following knee replacement surgery. Another lawsuit was filed by a man who had to have 15 surgeries after developing an infection following hip replacement surgery.

What is the problem?

The Schmidt Firm, PLLC is nationally recognized as a class action law firm, but our attorneys are not currently investigating a Bair Hugger class action. Instead, we are advocating for each of our clients by filing individual lawsuits.

About Class Actions

Class action lawsuits are typically filed by a “class representative” on behalf of a large group of people who all have the same legal claim — for example, buying a defective product. Members share legal expenses and divide any payout equally.

Why Our Law Firm is Filing Individual Lawsuits as Opposed to a Class Action

For individuals with very serious injuries, class actions can have serious disadvantages. Members may have to accept “low-ball” settlements or watch attorneys take a huge cut of the payout, leaving the rest for everyone in the class action to share.

There is no excuse for failing to warn about the risk of life-threatening infections from a defective medical device. If you or a loved one had an infection after hip or knee replacement surgery, heart valve surgery, or another type of surgery, you may be eligible to file a lawsuit.
