CPAP Sleep Machine Recall

The medical device manufacturer Philips is facing a growing number of lawsuits — including CPAP lung cancer lawsuits — from users who accuse the company of delaying recalls for 3.5 million sleep machines, including the Dream Station, BiPAP machines, and ventilators.

What is the Problem?

The recalled breathing machines contain PE-PUR foam, which can disintegrate into particles that enter the device’s air pathway. PE-PUR foam can also “off-gas” toxic chemicals. When a user breathes in the foam particles or chemicals, it may increase their risk of lung cancer.

What is a CPAP Machine?

Continuous Positive Airway Pressure (CPAP) machines, or “sleep machines,” are devices that help people breathe while they sleep.

CPAP machines are prescribed to treat obstructive sleep apnea, which is a condition that causes breathing to start and stop repeatedly during sleep. A person wears a face-mask or nosepiece that provides a steady air supply, which helps keep their airways open.

CPAP Lung Cancer Lawsuit Filed in Georgia

One of the first CPAP lung cancer lawsuits was filed by Frederick H., a man who was diagnosed with lung cancer in June 2021, soon after Philips recalled his REMStar Auto A-Flex device (also known as a “System One”).

As a result of using the device on a regular basis since 2015, he alleges that he suffered damage to his respiratory system, cellular damage, DNA damage, and was diagnosed with lung cancer.

In April 2021, Philips admitted that the company had received over 1,200 complaints about “black debris within the device’s air pathway,” as well as over 100 reports of people who developed side effects like headaches, lung irritation, coughing, chest pressure, and infections.

The CPAP Lung Cancer Lawsuit was filed on July 2, 2021 in the U.S. District Court for the Middle District of Georgia (Columbus Division) — Case Number 4:21-cv-00111-CDL.

What is Lung Cancer?

Lung cancer is a type of cancer that starts when cells begin growing uncontrollably in the lungs. The most common types of lung cancer are non-small cell lung cancer (NSCLC) and small cell lung cancer (SCLC).
