Farmers File Dicamba Class Action Lawsuits
July 2017 — Farmers who had crop damage as a result of dicamba drifting off the fields where it was sprayed have filed class action lawsuits (PDF) in federal court in Arkansas and Missouri. They are also seeking compensation for farmers who bought dicamba, dicamba-resistant seeds, or modified equipment to spray dicamba. Click here to read more.
Dicamba Drift Class Action Lawsuits for Crop Damage
Class action lawsuits have been filed on behalf of farmers in at least 10 states who suffered crop damage as a result of “dicamba drift.” Monsanto is accused of negligence for selling Roundup Ready 2 Xtend® — a new genetically-modified (GMO) soybean that was engineered to resist Roundup (glyphosate) and dicamba spraying.
Monsanto sold Xtend seeds before the EPA approved Monsanto’s drift-resistant formula of dicamba, warning farmers that actually using dicamba on the crop would be illegal and subject to a $1,000 fine.
Unfortunately, the temptation to kill weeds and boost profits was too great. Farmers throughout the U.S. sprayed dicamba illegally in 2016, causing at least 200,000 acres of crop damage in Alabama, Arkansas, Illinois, Kentucky, Minnesota, Mississippi, Missouri, North Carolina, Tennessee and Texas.
A farmer in Arkansas who lost 400 acres of soybeans said:
“It’s like putting ice cream in front of a kid and telling them they can’t eat it. All these farmers heard when it came to this system appears to be ‘higher yields’ and ‘dicamba-resistant’. The temptation has outweighed the consequences in this case.”
The class action was filed in February 2017 in the U.S. District Court for the Eastern District of Missouri — In RE: Steven W. Landers, et al v. Monsanto Company — Case No. 1:17-cv-00020.
