Intussusception Class Action Lawsuit

A number of childhood vaccines for rotavirus have been linked to higher rates of intussusception, a life-threatening intestinal disorder that can cause a bowel obstruction, perforation, peritonitis, or require surgery.

What is Intussusception?

Intussusception occurs when a piece of the intestine slides together inside itself, similar to a telescope collapsing. Nearly all cases occur in young children or infants, often where the large intestine and small intestine meet.

Intussusception becomes life-threatening when the blood supply to the intestines is cut off, resulting in tissue death. Food and fluid may not be able to pass through the body. It can also lead to a life-threatening bowel perforation or infection in the abdominal cavity.

Rotavirus Vaccines Linked to Intussusception

Experts have known about the risk of intussusception from rotavirus vaccines for over a decade.

In 1999, the most popular vaccine — RotaShield — was pulled off the market after studies found that it could cause 1 or 2 extra cases of intussusception for every 10,000 infants who received the vaccine.

The Centers for Disease Control (CDC) has also warned that some studies (but not all) have found higher rates of intussusception associated with RotaTeq and Rotarix vaccines. About 1 to 3 infants per 100,000 who receive these vaccines could potentially develop intussusception within 7 days, according to the CDC.

What is the problem?

The Schmidt Firm, PLLC is nationally recognized as a class action law firm. However, our attorneys are not filing an intussusception class action. Drug-makers are shielded from most lawsuits involving vaccine injuries. Instead, our lawyers help our clients seek compensation through a federal program designed for victims of vaccine injuries.

Why Our Law Firm is Filing Individual Lawsuits as Opposed to a Class Action

The Vaccine Injury Compensation Program (VICP) was created by Congress in 1988. Funded by a $0.75 excise tax on all vaccines, the program has paid out nearly $3 billion to thousands of people who were injured by vaccines.

Do I Need a Vaccine Injury Lawyer?

No. You are not required to have a lawyer to file a claim with the VICP. However, most people use an attorney because it is a complex legal process with strict deadlines and paperwork requirements. If you do use an attorney, the VICP will usually pay for reasonable lawyer’s fees and other legal costs, even if you do not win your case.

Are There Deadlines to File a Claim?

Yes. For injury claims, the filing deadline is 3 years from the start of the first symptom of the injury. For claims involving death, the filing deadline is within 2 years of the death or 4 years after the start of the first symptom.
