Jury Awards $80 Million in 1st Federal Roundup Cancer Trial

March 28, 2019 — A unanimous jury in San Francisco has awarded $80 million to a man who used Roundup weed-killer and developed lymphoma after finding that Monsanto failed to warn him about possible health risks.

It was the first federal lawsuit to go to trial in a litigation that now involves nearly 700 similar lawsuits from people with lymphoma who used Roundup and other glyphosate-based herbicides.

The plaintiff, 70 year-old Edwin Hardeman, testified that he used Roundup for 25 years to control weeds on his 56-acre property. He was diagnosed with non-Hodgkin lymphoma in 2015.

The jury awarded $200,967 in economic damages, around $5 million in past and future non-economic damages, and $75 million in punitive damages to punish Monsanto for downplaying the risk of cancer.

Lawyers for Hardeman presented the jury with evidence that Monsanto was aware of dozens of studies that linked Roundup products with cancer — and yet the company never warned consumers and refused to conduct its own long-term research.

Hardeman’s attorneys also accused Monsanto of secretly ghost-writing and editing multiple academic articles that found no evidence linking Roundup with cancer, allegedly in an effort to mislead government regulators and the public about the safety of Roundup.

Last summer, a state-court jury hit Monsanto with a $289 million verdict in favor of a former school groundskeeper who developed non-Hodgkin lymphoma from spraying Ranger Pro with minimal protection.

The lawsuit is In RE: Hardeman v. Monsanto Co. et al.Case No. 3:16-mc-80232 in the U.S. District Court for the Northern District of California.
