Judges May Centralize Individual Lawsuits

Janssen Pharmaceuticals has been hit with several lawsuits from people who developed ketoacidosis after taking Invokana. These lawsuits are not part of a class action — they are individual lawsuits. As the litigation continues to grow, judges may decide to centralize the cases in a “mass-tort” or Multi-District Litigation (MDL).

Overview

People with type-2 diabetes who use medications in the SLGT2 (sodium-glucose cotransporter-2) inhibitor class can develop ketoacidosis, according to recent warnings from the FDA. The agency received 73 reports of this side effect from March 2013 through May 2015. All of the patients were hospitalized. In December 2015, the FDA ordered drug-makers to add stronger warnings.

What is Ketoacidosis?

Diabetic Ketoacidosis (DKA) is a medical emergency in which the blood becomes too acidic. It occurs when body can’t use glucose (sugar) from food as an energy source because the pancreas is not making enough insulin. Instead, the body starts burning fat. This releases fatty-acids into the bloodstream, which the liver converts into toxins called ketones. As ketones levels increase, blood pH becomes more acidic and ketoacidosis occurs.

Complications

  • Dehydration
  • Low blood pressure
  • Shock
  • Cerebral edema (swelling in the brain)
  • Heart rhythm abnormalities
  • Diabetic coma (unconsciousness)
  • Death

What is the problem?

The Schmidt Firm, PLLC is nationally recognized as a class action law firm. However, our attorneys are not currently filing a ketoacidosis class action. Instead, we are filing individual lawsuits against pharmaceutical companies who sold diabetes medications in the SGLT2 inhibitor class on behalf of people who were diagnosed with ketoacidosis.

About Class Actions

Class actions are an efficient way to resolve a lot of similar legal claims all at once. Everyone joins together and collectively seeks compensation. Members also share any compensation awarded in a lawsuit verdict or settlement.

Why Our Law Firm is Filing Individual Lawsuits as Opposed to a Class Action

The problem with class actions is that they are not designed to maximize compensation for individual plaintiffs with severe injuries. Another problem is that members may have to accept a “low-ball” settlement or attorneys’ fees that take a huge cut of the payout.

Our lawyers file individual lawsuits because so we can focus on helping people with the most serious injuries. We specialize in helping victims of defective drugs file lawsuits against pharmaceutical companies and seek compensation for their medical expenses, pain and suffering, lost income, and more.
