Mirena Lawsuits Centralized in State, Federal Litigation

June 13, 2013 — At least 100 women have contacted a lawyer and filed a Mirena lawsuit. Over the last few months, several litigations have been established. Federal judges established a Multi-District Litigation (MDL) in April. In May, the New Jersey Supreme Court created a Multi-County Litigation (MDL) in Bergen County. It is expected that Bayer will face thousands of lawsuits from women who were injured when their IUD spontaneously migrated and caused a uterine perforation.

Most Mirena lawsuits will be transferred into the MDL, which was established under Judge Cathy Seibel in the U.S. District Court for the Southern District of New York (In Re: Mirena IUD Products Liability Litigation, MDL No. 2434). The MDL is an important milestone in the litigation, because it allows lawsuits filed in state courts to be transferred into one centralized litigation. At least 50 lawsuits are already pending here.

Another large, centralized litigation was created in Bergen County, New Jersey, before Superior Court Judge Brian R. Martinotti. Court records show that 19 cases were transferred into the Multi-County Litigation (MCL), but plaintiffs claim at least 60 lawsuits have been filed in the state.
