January 2014 — Plaintiff Sardeep Bardot filed an OxyElite Pro class action lawsuit in New Jersey. The class action is putative, meaning that it does not seek to represent plaintiffs who were injured — rather, Bardot alleges that he never would have purchased OxyElite Pro if USPLabs and GNC had warned him about the health hazards of DMAA and aegeline. $2 Million OxyElite Pro Class Action Settlement for False-Advertising
USPLabs, the Texas-based manufacturer of OxyElite Pro, agreed to a $2 million class action lawsuit settlement in February 2013, according to the New York Times. The class action consolidated several lawsuits claiming USPLabs violated California laws prohibiting false and misleading statements on dietary supplements.
As a condition of the settlement, USPLabs agreed to remove a controversial ingredient called DMAA from OxyElite Pro and Jack3D. They also placed stronger warnings on the label and promised to stop making misleading or false statements about their products. Consumers who purchased the products were eligible for up to $300 in compensation.
