Merck & Co.’s blockbuster hair-loss drug Propecia (finasteride) has been associated with severe side effects, including sexual dysfunction that persists after the drug is discontinued. Merck is facing more than 1,000 lawsuits involving Propecia and Proscar, but these are not part of a Propecia class action lawsuit — instead, they are individual lawsuits that have been centralized in federal and state litigation.

Propecia Class Action Lawsuits

Although The Schmidt Firm, PLLC is nationally recognized as a class action law firm, we are not seeking justice for our clients with a Propecia class action lawsuit. Instead, we are reviewing cases for individual Propecia lawsuits. If you decide to file a claim, you could join one of several centralized litigations that involve hundreds of lawsuits.

Your Propecia lawsuit could be awarded compensation for:

  • Pain and suffering
  • Medical expenses
  • Lost income
  • Decreased quality of life
  • Loss of consortium with spouse
  • Punitive damages
  • And more

What is the problem with class action lawsuits?

Class action lawsuits are not usually used to resolve large pharmaceutical drug injury litigation in the United States. Instead, individual plaintiffs join together in a Multi-District Litigation (MDL), which is similar to a class action lawsuit, but there are several important differences.

Unlike a Propecia class action lawsuit, which would consolidate many claims into one claim, plaintiffs in the Propecia MDL have filed individual lawsuits and they have their own lawyer. The advantage is that their lawyer can fight for the maximum amount of compensation the plaintiff deserves, and any compensation awarded does not need to be shared with other plaintiffs in a class action.

Propecia Lawsuits Centralized in Federal Litigation

The U.S. Judicial Panel on Multi-District Litigation (JPML) created the Propecia MDL on April 16, 2012. Within one year, over 400 Propecia lawsuits were centralized in the U.S. District Court for the Eastern District of New York before Judge John Gleeson. Lawsuits allege that Merck failed to warn about the risk of persistent sexual dysfunction after discontinuing Propecia.

There is also another Propecia litigation pending in New Jersey Superior Court. The claims are pending before Judge Jessica R. Mayer in the Middlesex County, New Jersey.
