October 20, 2015 — Law firms representing three people who were diagnosed with cancer after being exposed to Roundup have filed three lawsuits against Monsanto in Delaware Superior Court.
Reuters reports that attorneys are seeking plaintiffs for what could be a nationwide “mass tort” litigation. The lawsuits are similar to ones filed earlier this year in New York and California Enrique Rubio v. Monsanto.
Monsanto is accused of leading “a prolonged campaign of misinformation to convince government agencies, farmers and the general population that Roundup was safe.”
Plaintiffs include Joselin Barrera and Elias de Garza, two farm-workers and landscapers from Texas who were diagnosed with non-Hodgkin lymphoma after exposure to Roundup.
A third plaintiff, Judi Fitzgerald, is a horticulturalist who was exposed to Roundup in the 1990s and recently diagnosed with chronic lymphocytic leukemia (CLL). Fitzgerald previously filed a lawsuit in New York (Fitzgerald v. Monsanto) but asked for dismissal of the case so she could join the Delaware litigation.
The number of lawsuits has grown steadily since March, when an agency of the World Health Organization (WHO) declared Roundup a “probable human carcinogen.” Monsanto has aggressively defended the safety of Roundup, a weed-killer that brought in $4.8 billion in revenue last year.
