How Do I Know if I Have a Surgical Mesh Lawsuit?

If you were injured by a defective surgical mesh patch or plug, you may have a lawsuit against the manufacturer. It is important to find out what type of mesh you have — our lawyers can help, but you can also contact your doctor or the hospital where you had surgery.

The next step is being diagnosed with an injury. It is important to tell your doctor if you are having health problems related to surgical mesh. After we know what type of surgical mesh you have and your injury, the last step is proving that a defect in the mesh caused your injury.

However, one lawsuit that went to trial ended in a $1.5 million jury award to a man who was injured.

Know Before You File a Surgical Mesh Lawsuit

Here are a few things to know before you can file a surgical mesh lawsuit:

1. When / where you had surgery, and treatment for injuries. You will need to know the approximate date of your surgery, where it was performed, and any medical records or treatments related to your side effects.

2. The type of mesh and manufacturer. It is okay if you do not know who manufactured the type of surgical mesh that caused your injuries — this information should be in your medical records, which a lawyer can help you get from the hospital.

3. Time limit to file a lawsuit depends on where you live. Patients who were injured by defective or recalled surgical mesh have a right to seek compensation. Because you have a limited amount of time to file a lawsuit, contact a lawyer as soon as possible.

What is the problem?

The Schmidt Firm, PLLC is nationally recognized as a class action law firm, but we are not filing a class action lawsuit for surgical mesh complications. Instead, we are filing individual lawsuits for people who need compensation for surgical mesh injuries and side effects.

About Class Actions

Joining a class action is a special legal process. Once a person decides to participate in a class action, they waive their legal right to file a separate lawsuit. Another problem is that if compensation is awarded, everyone in the class action shares equally. This can have disadvantages for people with severe injuries.

Why Our Law Firm is Filing Individual Lawsuits as Opposed to a Class Action

Thousands of people who were injured by surgical mesh have filed lawsuits, but not as part of a class action. Instead, they are seeking compensation for mesh injuries by filing individual lawsuits with their own lawyer.

Our lawyers specialize in helping people who were injured by defective medical devices. If you decide to file a lawsuit for surgical mesh complications, you could receive compensation for your injury, medical expenses, permanent disability, lost income, and more.
