Tennessee Woman Files Invokana Kidney Failure Lawsuit

April 8, 2016 — A woman from Tennessee has filed a lawsuit claiming that Invokana causes kidney failure and Janssen Pharmaceuticals failed to warn her about the risk.

The lawsuit (PDF) was filed in the Superior Court of Delaware on March 31 by a woman from Bluff City, Tennessee (Case No. N16C-03-294 JAP). She developed severe and life-threatening complications of kidney failure after taking Invokana.

Janssen Pharmaceuticals, a subsidiary of Johnson & Johnson, is accused of negligence for failing to warn about the risk of kidney failure. In fact, the Consumer Medication Guide (PDF) only states that “kidney problems” are a “possible side effect” of Invokana. It makes no mention of kidney failure.

According to the complaint, the woman’s injuries could have been prevented if Janssen had provided adequate warnings about kidney failure and other life-threatening side effects, conducted proper safety studies, and investigated alarming safety signals. The drug-maker is accused of negligence for selling a defective and unreasonably dangerous medication.

In December 2015, the FDA reported that some patients developed kidney failure or needed dialysis as a complication of severe urinary tract infections. The problem is that urinary infections are one of the most common side effects. Invokana forces the kidneys to remove more sugar from the body in urine, which helps lower blood-sugar levels, but increases the risk of infections. Another problem is that diabetes itself can cause kidney disease (nephropathy) and kidney failure.
