April 10, 2015 — Three lawsuits involving more than a dozen plaintiffs are moving forward against Proctor & Gamble (P&G), the manufacturer of Tide Pods.
Lawsuits accuse P&G of selling an unreasonably dangerous product that has caused hundreds of serious injuries. A study published in Pediatrics last year found that, on average, one child in the United States was hospitalized after ingesting the products between 2012 and 2013 and 17,000 were exposed every year.
One of the lawsuits was filed on behalf of an elderly man with diminished mental capacity who ingested Tide Pods. Another lawsuit was filed on behalf of 13 children under six years old who were injured, according to WCPO Cincinnati.
Lawsuits accuse P&G of negligence for failing to anticipate injuries or design a safer product. The original product came in a clear jar with a screw-top lid. The detergent packets inside were brightly-colored, sweet-smelling, squishy, bite-sized, and resembled candy in a candy jar.
The problem is that the products contained highly-concentrated chemicals. About 90% of the ingredients in Tide Pods are active surfactants and enzymes, compared to just 50% of the ingredients in Tide Liquid and 10% for the leading value detergent.
Soon after P&G came under criticism, they re-designed the package with a more child-resistant lid. They also made the jar opaque so it looks less like a candy jar.
