Zubsolv Tooth Decay Lawsuits Consolidated in MDL

In February 2024, dozens of tooth decay lawsuits for buprenorphine medications were centralized into a Multi-District Litigation (MDL) in the Northern District of Ohio. The MDL is IN RE: Suboxone (Buprenorphine/Naloxone) Film Products Liability Litigation — Case Number 1:24-md-03092.

What is Zubsolv?

Manufactured and marketed by Orexo, Zubsolv is prescribed to treat opioid use disorder (OUD), a condition that occurs in people who have a physical and psychological reliance on opioids. Zubsolv is sold in sublingual tablets that contain a combination of buprenorphine and naloxone.

Buprenorphine is a partial opioid agonist that acts on receptors used by drugs like heroin and oxycodone. At the proper doses, buprenorphine doesn’t make people feel intoxicated or impaired; however, it can reduce drug cravings and “trick” the brain into believing it has access to the substances it craves.

Naloxone is an opioid antagonist, capable of kicking drugs off their receptors and delivering immediate sobriety. If people take too much of their prescription, or they relapse to other drugs like heroin, naloxone keeps those substances from working.

Dental Side Effects Linked to Buprenorphine-Containing Medications: FDA Warning

Dental problems have been reported with medications containing buprenorphine (one of the main active ingredients in Zubsolv), according to an FDA warning [1.] issued on January 12, 2022.

Serious dental side effects of buprenorphine were reported in more than 300 patients, many of whom had no history of dental issues, and included tooth decay, cavities, oral infections, and loss of teeth. Reports indicate that one or more teeth may be affected and tooth extraction/removal is the most common treatment.

Serious dental side effects of Zubolv may include:

  • Tooth decay
  • Cracked teeth
  • Cavities
  • Oral infections
  • Tooth loss
  • Dental Caries (loss of enamel, dentine, or other tooth substances)
  • Root canal
  • Tooth extraction
  • Crown replacement

Zubsolv Lawsuit Allegations

Zubsolv lawsuits allege that Orexo engaged in wrongful and negligent conduct in connection with the development, design, testing, labeling, packaging, promoting, advertising, marketing, distribution, and selling of Zubsolv.

Specifically, these lawsuits claim that Orexo knew or should have known that when Zubsolv is used as prescribed and intended, the drug has the potential to cause harmful damage to the teeth due to the acidity of buprenorphine. Despite this knowledge, plaintiffs allege that the manufacturer sold and marketed Zubsolv without warning about its tooth decay risks.

Recommendations for Patients

If you are currently taking Zubsolv, the FDA recommends taking the following tips to minimize your risk of tooth decay and other dental side effects:

  • Schedule an appointment with your dentist after initiating treatment with Zubsolv and inform your dentist that you are taking it.
  • Seek immediate dental treatment if you experience any problems with your teeth or gums while taking Zubsolv.
  • When taking Zubsolv and after it is completely dissolved, take a large sip of water, swish it gently around your teeth and gums, and swallow. Wait at least 1 hour before brushing your teeth.
  • Do not suddenly stop taking Zubsolv without consulting your doctor, as it could lead to serious consequences, including relapse to opioid misuse or abuse that could result in overdose and death.
  • You could also become sick with withdrawal symptoms because your body has become used to the drug.

Will There Be a Zubsolv Class Action Lawsuit?

Given the number of Zubsolv lawsuits our attorneys expect to be filed in the coming weeks and months, we believe these cases will ultimately be consolidated as part of a multidistrict litigation, or MDL, rather than a class action lawsuit.

The main difference between a multidistrict litigation and a class action is the status of the plaintiffs within the litigation. MDLs often involve a group of distinct individuals or groups of individuals. Because of this, MDL cases typically consist of many individual cases, as opposed to a class action suit where one or more plaintiffs represent a larger group of individuals.
