Diacetyl and Lung Disease

Workers at microwave-popcorn and flavoring factories have developed the severe lung disease bronchiolitis obliterans (“Popcorn Lung”) after exposure to diacetyl in butter flavoring. This disease inflames and scars the smallest airways in the lungs, making it hard to breathe.

Symptoms of Lung Disease

  • Cough (usually without phlegm)
  • Wheezing
  • Shortness of breath that worsens on exertion
  • Fever
  • Night sweats
  • Weight loss

Diacetyl in Vaping Liquids for E-Cigarettes

Diacetyl is an ingredient in most flavored vaping liquids and e-cigarettes. The daily exposure limit for diacetyl is 65 μg/day, but many flavored vaping liquids contain significantly more diacetyl than is considered safe. In 2015, Harvard researchers completed an analysis of 51 vaping liquids and found diacetyl in 76% of products, up to 239 μg/e-cigarette.

Diacetyl Class Action Lawsuits

Several class action lawsuits have also been filed against manufacturers of vaping liquids that contain high levels of diacetyl, including Cuttwood LLC and Five Pawns Inc. According to the lawsuit (PDF) against Five Pawns:

“If a person inhales just 2ml of Absolute Pin e-liquid they will be over the recommended intake for [diacetyl] and more than 36 times over the recommended daily limit for [acetylpropionyl].”

What is the problem?

The Schmidt Firm, PLLC is nationally recognized as a class action law firm, but we are not currently filing a class action lawsuit involving diacetyl-flavored vaping liquids. Instead, we are filing individual lawsuits and only accepting cases involving severe lung diseases, such as:

  • Popcorn Lung
  • Bronchiolitis obliterans
  • Chronic Obstructive Pulmonary Disease (COPD)
  • Lung disease
  • Fixed airway obstruction
  • Chronic bronchitis
  • Asthma
  • Diseases of the small airway
  • Breathing problems

About Class Actions

Class actions have been filed against several vaping liquid manufacturers by customers who are seeking refunds after purchasing products containing diacetyl. However, these class actions are not designed to maximize compensation for people who developed lung disease.

Why Our Law Firm is Filing Individual Lawsuits as Opposed to a Class Action

Members of a class action might have to accept high attorneys’ fees, a “low-ball” settlement, and watch the payout divided among everyone in the lawsuit. Instead of a class action, our attorneys are filing individual lawsuits. We specialize in helping victims of defective products seek justice for their injuries. If you were diagnosed with bronchiolitis obliterans (“Popcorn Lung”) after vaping diacetyl in e-cigarettes, you may be eligible to file a lawsuit.
