April 16, 2014 — The U.S. Judicial Panel on Multidistrict Litigation (JPML) has announced (.PDF) that nearly 50,000 vaginal mesh lawsuits are pending in consolidated federal litigation.
The cases are currently pending before U.S. District Judge Joseph R. Goodwin in the Southern District of West Virginia. The first “bellwether” trials are scheduled to begin in the coming months and will likely continue well into next year.
The trials will be closely-watched and critical to the outcome of tens of thousands of lawsuits. Bellwether trials are useful ways to place value on certain types of injuries, which can help lawyers avoid the burden and expense of trial for individual lawsuits with similar allegations.
Earlier this month, a Texas woman was awarded $1.2 million for vaginal mesh injuries. The jury found that her TVT-O vaginal mesh was defective, but they did not fault Johnson & Johnson’s Ethicon unit for failing to warn about the risks.
