$21 Million Settlement in 500 Bard Vaginal Mesh Lawsuits

October 9, 2014 — C.R. Bard has agreed to pay $21 million to settle 500 vaginal mesh lawsuits filed by two law firms, for an average payment of about $43,000 per plaintiff, according to Bloomberg.

Bard announced the settlements in July but did not disclose the amount until now. In regulatory filing, Bard reported $259 million in litigation-related expenses, including $4.2 million in attorneys’ fees related to a court-ordered preparation of about 200 cases for trial.

Bard reported facing 12,445 lawsuits as of July 2014. The company has faced several trials in the last few years, but this is the first settlement. All of the lawsuits were filed by women who accuse the device-maker of selling a defective and dangerous product while failing to adequately warn about its risks.

Bard has lost two cases that have gone to trial. In July 2012, a jury awarded plaintiff Christine Scott $5.5 million in damages. In August 2013, a jury awarded plaintiff Donna Cisson $2 million in damages, including compensation and punitive damages. Bard settled a lawsuit filed by plaintiff Wanda Queen just before a trial began.

Other manufacturers of vaginal mesh have also recently agreed to settlements. A few weeks ago, Endo Pharmaceuticals agreed to resolve “substantially all” claims involving vaginal mesh, setting aside $1.6 billion to settle 20,000 lawsuits.

Over 60,000 women have filed lawsuits for injuries caused by vaginal mesh. They accuse device-makers of failing to adequately test or design their products. In recent years, the FDA has ordered dozens of new safety studies and warned that serious complications are “not rare.”
