UPDATE: 41 Deaths Linked to E-Scooters and Micro-Mobility Products

From 2017 through 2019, at least 41 deaths and 133,000 people had to go to the ER for severe injuries after accidents on e-scooters or micro-mobility products, according to the U.S.Consumer Product Safety Commission (CPSC).

What are Bird Scooters?

Bird is a California-based company that operates a system of re-chargeable dockless electric scooters (“e-scooters”). Riders download an app, pay a fee-per-mile, and rent the Bird scooter for short rides.

What is the Problem?

Bird scooters go up to 15 miles an hour on flat roads, but they can go even faster downhill. Unfortunately, even at relatively slow speeds, accidents involving Bird scooters can be devastating — especially when they involve pedestrians, children, cars, or falling off the scooter.

Woman Files Lawsuit After Falling Off Bird Scooter

In December 2018, a woman filed a scooter injury lawsuit after she fell off a Bird scooter. She was seriously injured when the brakes failed as she was going downhill, according to her lawyer:

“Though scooter companies report that the top speed of the scooters is 15 mph, I believe that the scooters may go much faster downhill. I believe that the brakes may be insufficient to stop a scooter going down a steep hill.”

Does the Rental Agreement Prevent Bird Scooter Injury Lawsuits?

Before a rider can use a Bird scooter, they must agree to the Terms & Conditions in the rental agreement. In many cases, this agreement protects Bird from any lawsuits involving injuries on their scooters.

However, there are exceptions. Bird may face financial responsibility if the were somehow responsible for a rider’s injuries — for example, operating a scooter that malfunctioned, or had defective parts, or broke in half during a ride.

E-Scooter Lawsuits Against Cities and Others

Bird scooter riders may also be able to file a lawsuit against the city if their injury was caused by the city’s failure to maintain streets and sidewalks. Lawsuits might also be filed against a distracted driver who caused an accident, pedestrians, or the manufacturer of a bad part.
