May 25, 2023 — A lawsuit has been filed after a deadly outbreak of mushroom poisoning was linked to a sushi restaurant in Montana.
As of May 15, 2023, investigators have found 50 people who got sick after eating at Dave’s Sushi in Bozeman, Montana, between March 28 and April 17, 2023, of whom 44 reported eating morel mushrooms.
Three people were hospitalized and two people died within days of eating the sushi.
The outbreak was linked to the “Special Roll,” which contained morel mushrooms that were cultivated in China and shipped to the U.S.
Other states also received the morel mushrooms, but so far, illnesses have only been linked to Dave’s Sushi, according to health officials.
Earlier this month, a wrongful death lawsuit was filed by the husband of a woman who died after eating the mushrooms.
He claims that she fell ill approximately 1 hour after eating the mushrooms at Dave’s Sushi and collapsed at home. She was taken by ambulance to the hospital, but went into cardiac arrest, suffered multi-organ failure, and died 13 days later, on April 29.
The FDA said “this appears to be a localized issue and no illnesses have been identified outside of the single restaurant in Montana.”
Morel mushrooms are edible mushrooms that are rarely cultivated because they go bad so quickly after being picked. Morel mushrooms are generally considered safe to eat, but they do contain a toxin that can make people sick, according to the FDA.
