Michael E. Schmidt, Managing Partner of Schmidt & Clark, LLP and The Schmidt Firm, PLLC, was recently elected to the Plaintiffs’ Steering Committee in the Judicial Council Coordination Proceeding No. 4749 in Los Angeles Superior Court. The coordination proceeding applies to Granuflo and Naturalyte injury claims nationwide.  This appointment establishes Mr. Schmidt in a leadership position in the litigation along with rest of the JCCP leadership panel.

A nationwide recall was issued for NaturaLyte and GranuFlo on March 29, 2012.  Use of Fresenius Medical Care’s popular dialysis treatment products GranuFlo and NaturaLyte has been linked to a six-fold increased risk of cardiopulmonary arrest and sudden cardiac death.

What are GranuFlo and Naturalyte?

Fresenius Medical Care provides dialysis treatment for the majority of Americans with end-stage kidney failure. They operate more than 1,800 clinics and manufacture dialysis treatment products such as GranuFlo Dry Acid Concentrate and Naturalyte Liquid Acid Concentrate.

GranuFlo and Naturalyte are used in the dialysate solution, which is added to the blood of hemodialysis patients to balance the pH. The products are combined with bicarbonate. Unfortunately, certain substances in GranuFlo and Naturalyte are converted to bicarbonate, which can potentially cause a bicarbonate overdose, metabolic alkalosis, cardiac arrest, and death.

What’s the problem?

Fresenius began investigating the risk of sudden cardiac arrest and death after 941 patients died at their clinics in 2010. In November 2011, they sent an internal memo to their own doctors to warn that cardiac arrests were 6 to 8 times more likely in patients with bicarbonate overdoses, which could be caused by improper doses of GranuFlo or Naturalyte.

Unfortunately, Fresenius only sent the memo to their own doctors. The FDA only received the memo after an anonymous source leaked it sometime in 2012. The FDA is currently investigating whether Fresenius wrongfully withheld risk information.

GranuFlo and Naturalyte Recall

Fresenius published an Urgent Product Notification in March 2012, which warned all doctors using GranuFlo or Naturalyte (including non-Fresenius doctors) about the increased risk of cardiac arrest and death. In June 2012, the FDA issued a Class 1 recall of GranuFlo and Nauralyte.

GranuFlo and Naturalyte were marketed and sold from January 2008 until June 2012.
