1st Genki Sushi Lawsuit Filed in Hawaii

In August 2016, the first lawsuit (PDF) was filed against Genki Sushi by a man from Oahu who was diagnosed with hepatitis A. The victim developed liver inflammation and had to be hospitalized for 7 days. Click here to read more.

Scallops “Likely Source” of Hepatitis A Outbreak

The lawsuit was filed less than 24 hours after the Hawaii Department of Health said the “likely source” of the outbreak was frozen scallops imported from the Philippines and served raw by Genki Sushi.

Outbreak Sickens 292 People

As of January 11, 2017, health officials confirmed 292 people were infected with hepatitis A, including 74 people who were hospitalized since June 12, 2016. Only 18 victims are not from Oahu. The state embargoed imports of scallops from Koha Foods of Honolulu. Genki Sushi also closed 11 restaurants on Oahu and Kauai for cleaning.

Symptoms of Hepatitis A

Hepatitis A does not always cause symptoms, and it can take 2-6 weeks before symptoms appear. When they do, most people feel very sick for several months. The infection is rarely life-threatening, but sometimes causes permanent liver damage.

Symptoms of hepatitis A infection:

  • Low-grade fever
  • Fatigue
  • Nausea and vomiting
  • Abdominal pain
  • Dark urine
  • Jaundice (yellowing of skin and eyes)

What is the problem?

The Schmidt Firm, PLLC is nationally recognized as a class action law firm, but our lawyers are not filling a class action lawsuit against Genki Sushi. Instead, we are filing individual lawsuits for people with hepatitis A.

About Class Actions

Class action lawsuits can be problematic in big food poisoning outbreaks. Some victims are only sick for a few days, while others are hospitalized or suffer months of debilitating symptoms. Because each case is so different, they need to be handled individually.

Why Our Law Firm is Filing Individual Lawsuits as Opposed to a Class Action

The problem with class actions is that they are not designed to maximize compensation for individuals with the most serious injuries. Members of a class action may have to accept a “low-ball” settlement or higher attorneys’ fees.

There is no excuse for selling food contaminated with hepatitis A. Our lawyers specialize in helping victims of food poisoning outbreaks seek financial compensation for their pain and suffering, medical expenses, lost income, permanent injuries, and more.
