Hyland’s Recalls Homeopathic Baby Teething Tablets

April 13, 2017 — The FDA has announced a Class I recall for all Hyland’s homeopathic infant teething tables. The FDA found widely inconsistent levels of toxic belladonna in the products, sometimes far exceeding the amount claimed on the label.

FDA Reports 400 Injuries and 10 Baby Deaths

In September 2016, the FDA again warned against using the products. Between 2010 and 2016, the agency received over 400 reports of children who had seizures and other symptoms consistent with belladonna poisoning, including 10 babies who died.

Symptoms of Deadly Nightshade Poisoning

  • Seizures
  • Trouble breathing
  • Lethargy
  • Excessive sleepiness
  • Muscle weakness
  • Skin flushing
  • Constipation
  • Trouble urinating
  • Agitation or irritation

Heart-Wrenching Reports of Sick Babies

Hyland’s still says teething tablets are completely safe, but hundreds of parents have told the FDA heart-wrenching stories of their babies suffering seizures, losing consciousness, or dying:

“My daughter had a seizure, lost consciousness, and stopped breathing about 30 minutes after I gave her three Hyland’s Teething Tablets… She had to receive mouth-to-mouth CPR to resume breathing and was brought to the hospital.”

Hyland’s Offers $2.9 Million Class Action Settlement

In October 2016, Hyland’s proposed a $2.9 million settlement (PDF) to end a class action lawsuit and reimburse people who bought Baby Teething Gel and other homeopathic products for children after March 2008. The case is Enzo Forcellati et al. v. Hyland’s Inc. et al. in the Central District of California — Case No. 2:12-cv-01983.

Hyland’s Homeopathic Class Action in New York

In January 2016, two women in New York filed a class action (PDF) accusing Hyland’s of advertising homeopathic baby products as “safe and effective” when they actually posed safety risks. According to the lawsuit:

“Contrary to defendant’s advertising, the products are not ‘natural’ and contain various artificial and synthetic ingredients, some of which are associated with the development of severe health problems.”

The case is pending in the Southern District of New York — In Re: Marie Kaatz, et al. v. Hyland’s Inc., et al. — Case No. 7:16-cv-00237.

FDA: Throw Out Hyland’s Teething Tablets & Gel

In October 2010, the FDA warned consumer against using Hyland’s Teething Tablets & Gels because they could harm children. The FDA reported that a child had a seizure after being given the product. The agency tested the products and found inconsistent amounts of belladonna (“deadly nightshade”).

Hyland’s Recalled Teething Tablets in 2010

Hyland’s recalled Teething Tablets & Gels in October 2010 and “re-formulated” the product, but did not remove belladonna. It returned to store shelves by early 2011. In October 2016, CVS pulled all homeopathic teething products off shelves and Hyland’s discontinued the products in response to new FDA warnings about belladonna poisoning.

What is the problem?

The Schmidt Firm, PLLC is nationally recognized as a class action law firm in Texas, but our trial attorneys are not filing a class action lawsuit against Hyland’s Homeopathic. Instead, we are filing individual lawsuits for children who were injured by Teething Tablets & Gels.

About Class Actions

Hyland’s is facing several class action lawsuits, but not involving people who experienced health problems. Instead, class action lawyers are seeking refunds for everyone who bought a homeopathic product that was falsely advertised.

Why Our Law Firm is Filing Individual Lawsuits as Opposed to a Class Action

Class actions are efficient when a lot of people have similar injuries, but they are not designed to maximize compensation for individual plaintiffs who were seriously injured or died.

Our lawyers file individual lawsuits so we can focus on helping people with the worst injuries from dangerous medications. If you file a lawsuit, you could receive compensation for your child’s pain and suffering, medical expenses, permanent injuries, or wrongful death.
