January 31, 2023 — With more than 50 hair relaxer lawsuits filed nationwide, federal judges are considering whether to centralize the cases into a Multi-district Litigation (MDL).
The lawsuits have been filed against beauty companies like L’Oreal, SoftSheen-Carson, Strength of Nature, and Namaste Laboratories.
Women claim that these companies failed to warn them that hair relaxers contain endocrine-disrupting chemicals, like phthalates, which may increase the risk of several long-term health problems.
On November 15, a group of women filed a motion to transfer the lawsuits into a federal MDL in the Northern District of Illinois.
Similar to a class action, a single judge would oversee the litigation, which streamlines the discovery process and other pre-trial issues.
According to the motion, “Defendants knew or should have known that their hair relaxer products were dangerous and defective because they contain highly toxic EDCs [Endocrine-Disrupting Chemicals] and they manufactured, marketed and sold them anyway.”
L’Oreal and other companies oppose consolidation, calling the lawsuits “amorphous complaints” that blame a variety of health problems on “undisclosed chemicals in undisclosed products.”
The case is In re: Hair Relaxer Marketing, Sales Practices, and Products Liability Litigation — MDL No. 3060.
