July 5, 2023 — A woman who was injured while fixing her daughter’s bicycle from Academy Sports has filed a lawsuit against the company.
The plaintiff, Alfreda W., is a mother from Texas who claims that she was injured by a defective Ozone 500 bicycle in July 2021.
As her daughter was riding the bike, the seat suddenly collapsed onto the rear tire. Her father picked up the bike and held it steady so that Alfreda could try to fix the problem, according to the lawsuit.
When she tugged on the rear shock spring, it released and crushed her middle finger on her right hand, causing a bone fracture.
Only 11 days afterward the bike was recalled because the rear shock spring can get stuck, creating a “pinch point” between the spring and the seat.
In her lawsuit, she claims that the Ozone 500 bicycle was defectively designed due to the pinch point, which could have been avoided with a safer design.
The lawsuit was filed against Academy LTC and Academy Sports + Outdoors on June 29, 2023 in the U.S. District Court for Harris County, Texas— Case Number 2023-40074.
