Massage Envy Sexual Assaults

The nationwide chain Massage Envy Spa has received over 180 reports of women who say they were sexually assaulted by their massage therapists during treatments. The reports cite police reports, lawsuits, and other complaints to back up the allegations.

According to a report published by Buzzfeed News in November 2017:

“Customers have been violated in shocking ways, then seen their reports brushed aside, while offending therapists have been allowed to keep their professional standing with no consequences.”

Failure to Report Sexual Assault

In most states, massage parlors and spas are not required to tell the police when sexual assaults occur. Massage Envy does not require its spas to file formal charges with law enforcement, display reporting policies, or hire qualified investigators to determine what happened.

Instead, Massage Envy tells its franchisees that all they must do is conduct their own “prompt, fair, and thorough” investigation of sexual assault claims — but it provides little guidance on how to do so. Few employees say they feel capable conducting their own investigations.

Who is Responsible?

In lawsuits, Massage Envy says it isn’t responsible for sexual assaults because the spas are franchises. The company insists that each spa is responsible for investigating inappropriate conduct on their own.

Sex Abuse Continues When Police Aren’t Notified

Unfortunately, the result is that women continue to be sexually assaulted at Massage Envy Spas. Some businesses have kept massage therapists on staff even after multiple complaints. Others failed to report their sexual assaults to police after quietly firing the therapist, allowing the therapist switch jobs and continue the assaults.

According to one lawyer who has filed lawsuits against dozens of Massage Envy Spas:

“An inordinate amount of people are attracted to massage therapy because of sexual interest. There’s opportunity in the massage room. When you get a massage, your guard is down completely. You’re not expecting to be violated.”

The American Massage Therapy Association says it “strongly believes that any massage therapist who steps over the line to inappropriate touch should face the legal consequences.”
