FDA Issues Safety Warning For MAGEC System Tissue Incompatibility

In July 2021, the FDA issued a Safety Communication to warn patients and doctors about reports of tissue incompatibility (biocompatibility) with the following NuVasive MAGEC devices:

  • MAGEC Spinal Bracing and Distraction System
  • MAGEC 2 Spinal Bracing and Distraction System
  • MAGEC System
  • MAGEC System Model X device
  • MAGEC System Model X rod
  • MAGEC System Rods

What is the Problem?

In February 2020, NuVasive issued an recall for all MAGEC devices to repair a mechanical problem where the endcap was separating from the rod. In July 2020, NuVasive released the new MAGEC Model X rod. Unfortunately, additional biocompatibility issues involving local tissue reactions were reported in December 2020 when NuVasive issued an updated Field Safety Notice.

MAGEC Rods Release Titanium and Metal

January 2018 — A new study of the MAGEC Rod System for children with early-onset scoliosis has found that it “significantly releases titanium and possibly aluminum,” and also releases the metal vanadium. Click here to read more.

NuVasive MAGEC System for Scoliosis

NuVasive Inc. manufactures the MAGEC System, a magnetically-controlled titanium rod for the treatment of children with scoliosis. Unlike traditional “growing rods,” which require surgery to be lengthened as the child grows, the MAGEC System is extended with a non-invasive magnet in a doctor’s office every 3-6 months.

MAGEC System Side Effects

The MAGEC System has been linked to many serious side effects in a number of recent studies. One of the most serious problems is metallosis, or the accumulation of metal debris around the implant, possibly as a result of the metal-on-metal parts grinding together when the rods are extended.

The most serious MAGEC System side effects include:

  • Metallosis (metal poisoning in the blood)
  • Broken rods
  • Rods failing to lengthen or expand
  • Rods bending or separating
  • Drive pin fracture
  • O-ring seal failure
  • Anchor failure
  • Fractured pin used to stabilize the rod
  • Loose hardware
  • Revision surgery

MAGEC System Metallosis (Metal Poisoning)

Metallosis has been found in dozens of children with the MAGEC System — all 34 patients in one recent study had significant metal debris and O-ring seal failure around the implant.

“The combination of high volumes of titanium wear debris alongside O-ring seal damage likely accounts for the metallosis reported clinically around some MAGEC rods.”

As metal particles accumulate, it can cause severe tissue damage (necrosis), pain, inflammation, and swelling — increasing the risk that the child will need revision surgery to remove the MAGEC rods.

Furthermore, metallosis is a serious concern in children because tiny particles of titanium can get into the bloodstream. Unfortunately, no one knows the long-term side effects of titanium metallosis in children.

Can I Join a Class Action Lawsuit?

The Schmidt Firm, PLLC is nationally recognized as a class action law firm, but we are not currently filing a MAGEC System class action lawsuit. Instead, we are filing individual lawsuits against NuVasive on behalf of children who had severe side effects, metallosis, or needed an unplanned revision surgery for a defective MAGEC System.

About Class Actions

Class actions are typically filed by an individual on behalf of everyone else who has the same legal claim against the some defendant. The advantage is that everyone can join together and collectively seek compensation. If compensation is awarded through a jury verdict or a settlement, the money is divided equally with everyone in the lawsuit.

Why Our Law Firm is Filing Individual Lawsuits as Opposed to a Class Action

Our lawyers file individual lawsuits so we can focus on seeking maximum compensation for the people with the most serious injuries. We specialize in holding big companies accountable for selling defective devices, failing to warn about side effects, and more.
