November 13, 2014 — USPlabs, LLC, the Texas-based maker of OxyElite Pro, Jack3D, and Versa-1, has agreed to pay $2 million to settle a false-advertising class action lawsuit in Florida.

The proposed settlement would resolve Velasquez v. USPlabs, LLC, case No. 4:13-cv-00627 in the U.S. District Court for the Northern District of Florida.
Lawyers accused USPlabs of violating the law by making false or misleading statements about the safety, effectiveness, and legality of their supplements. USPlabs has admitted no wrongdoing or illegal action.
If you purchased any of these products, you have until February 5, 2015 to file a claim. To qualify, you must have a receipt or affidavit signed under penalty of perjury. Valid claimants are eligible for up to $150 in reimbursement — $35 per bottle of OxyElite Pro, $20 per bottle of Jack3D, and $20 per bottle of VERSA-1.
OxyElite Pro and Jack3D were originally sold with dimethylamylamine (DMAA), a stimulant that was pulled off the market by the FDA in 2012, after it was linked to over 80 adverse events.
After fighting the FDA for a year, USPlabs re-formulated OxyElite Pro and started selling Versa-1 with aegeline, another unapproved ingredient. In 2013, OxyElite Pro was recalled after dozens of people developed liver damage and one woman died of liver failure.
This is at least the third time USPlabs has paid $2 million to settle false-advertising class actions — the first was settled in 2012 in California, and the other was settled in September 2014 in Florida on behalf of four plaintiffs. Another class action was filed in January and is pending in New Jersey.
